Court stays construction work at Jogeshwari Caves

HC orders that restricted areas around caves be earmarked and encroachment be stopped
The committee formed to record various shortcomings in maintaining five caves in Mumbai, looking into various aspects such as entrance, access ways, and encroachment etc. submitted its observation before the High court. The status at the caves is generally bad and the authorities are not paying much heed to the same. At Jogeshwari caves the things are the worst observed the committee.
It was submitted that at Jogeshwari sewage and drainage water seeps through the roof of the cave. The reports were submitted to the municipality. The Director Archaeological Survey who is also chairperson of the committee had written to the Municipality that a builder in Jogeshwari has caused severe damage to the cave. According to notification by the MCGM area of 100 meters surrounding a heritage structure is prohibited area and beyond that upto 200 meters the area is known as regulated area where no construction activity other than that recommended by Archaeological department could be carried out.
But at Jogeshwari all sort of illegal activities take place even within 100 meters. The committee had communicated to the MCGM and the builder Milind Realtors asking them to ensure not to encroach on the regulated area. Both assured that there won’t be any construction activity but the same still continues.
The amicus curie in the matter says that there is a whole colony around the cave. The committee will be visiting the place on Saturday after which they will decide on what could be done about removing the encroachment and such other issues. It ws further submitted that the local director had asked for additional staff. At Kanheri caves the requirement is that of 12 members as the area is huge but at present there are only four security guards. At other caves such as Mandapeshwar and Mahakali there are only two or three guards. How can one expect to stop encroachment with inadequate staff, asks the committee.
The court ordered to stay the construction activity at Jogeshwari caves. The MCGM should file an affidavit by June 2 and it should ensure that there is no construction in the restricted area. The Archaeological Survey of India will provide adequate security within two weeks. The boundaries of the prohibited and restricted areas should be ascertained. The matter will be heard on June 22.
